1MSManager – Terms of Service

These Terms of Service ("Terms") govern your use of the 1MSManager software-as-a-service platform ("Service") and the 1MSManager Web Extension ("Extension"). By creating an account, accessing the Service, or using the Extension, you agree to these Terms.

1. Definitions

"1MSManager", "we", "us", "our" refer to the provider of the Service. "User" refers to any individual or entity that creates an account or uses the Service or Extension.

2. Scope of the Service

1MSManager provides tools for:

• Importing product data from Amazon
• Publishing and managing eBay listings
• Tracking stock and prices
• Running repricing rules and automations
• Facilitating Amazon → 1MSManager → eBay workflows through a browser extension

The Service is provided "as is" without any guarantee of sales, profit, or business performance.

3. Account Registration and Security

Users agree to provide accurate and up-to-date information, keep login credentials confidential, and take responsibility for all activity performed under their account. If you suspect unauthorized access, you must notify us immediately.

4. Amazon and eBay Integrations

1MSManager reads only product information available on Amazon pages you open, accesses eBay solely through the permissions you grant, does not request or store your Amazon or eBay passwords, and uses secure authorization tokens for access. Users are solely responsible for complying with Amazon and eBay policies.

5. Payments, Subscriptions, and Credits

Certain parts of the Service require payment. Subscription fees and package prices are listed clearly within the platform and may renew automatically. Users must ensure their payment method is valid, and cancellations must follow the instructions provided in the platform. Payments are processed by trusted third-party payment providers such as Stripe.

6. Acceptable Use

Users may not use the Service to violate any applicable laws or regulations, breach Amazon or eBay policies, create deceptive or misleading listings, attempt unauthorized access to systems or accounts, reverse-engineer, copy, or modify the Service, or misuse automations for abusive or harmful actions. Violations may result in account suspension or termination.

7. Service Modifications

1MSManager may update or modify features, add, remove, or adjust functionalities, and perform maintenance or temporarily suspend operations. Where feasible, users will be informed in advance of significant changes.

8. Disclaimer of Warranties

The Service is provided without warranties of any kind. There is no guarantee of profit, sales, or financial results, no guarantee of uninterrupted or error-free operation, and no guarantee that suggestions, automations, or AI-generated content will be accurate. Users bear all commercial and operational risks.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for lost profits, revenue, business opportunities, or indirect or consequential damages. We are not responsible for losses resulting from pricing errors, stock issues, automation behavior, or marketplace policy violations, and we do not guarantee the accuracy of AI-generated content. Our total liability is limited to the amount the user has paid for the portion of the Service giving rise to the claim. Nothing in this section limits liability that cannot legally be limited.

10. Termination

Either party may terminate the account at any time. We may suspend or terminate accounts immediately if the Service is misused, payments fail or remain unpaid, marketplace rules are violated, legal obligations require action, or security risks are detected. Upon termination, access to the Service may be discontinued except where retention is required by law.

11. Third-Party Services

The Service integrates with certain third-party platforms such as Stripe (payments), Amazon (product data reading), eBay (listing management), and OpenAI or similar AI providers (AI-assisted text or image improvements). Each third party has its own terms and policies, which the user automatically accepts by using the Service.

12. Privacy

Our Privacy Policy explains how data is collected, used, and protected. By using the Service, you also agree to the Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the jurisdiction where the company is registered. Disputes shall be resolved by the competent courts of that jurisdiction.

We may update these Terms from time to time. Changes take effect once published on our website or within the application. Continued use of the Service constitutes acceptance of the updated Terms.
